EmergencyLights4Less.com reserves the right to accept or reject any and all orders. Orders become valid and the sale shall be deemed made in Sunbury, Northumberland County, Pennsylvania, subject to the terms set forth herein, when accepted by EmergencyLights4Less.com, Sunbury, Northumberland County, Pennsylvania. All sales are subject to the laws of the State of Pennsylvania, and the venue for all disputes shall be in the courts of Northumberland County, Pennsylvania. No change, modification or revision of your order shall be valid unless agreed to in writing by EmergencyLights4Less.com.

WE RESERVE THE RIGHT TO REFUSE TO SELL OR SHIP MERCHANDISE TO ANYONE.

Although we make every effort to keep our web site error-free, occasionally mistakes occur. We reserve the right to correct these errors ( including pricing errors or otherwise ) and apologize for any inconvenience.

When you place an order with us for products that are subject to any legal restrictions, you warrant to us that you are authorized to make such purchase, and that you are in compliance with all local, state, and federal laws concerning the same.

PAYMENTS: All payments must be made in U.S. Dollars. Sorry, no C.O.D. Orders. We accept online ordering using VISA, MASTERCARD, AMERICAN EXPRESS or DISCOVER cards. We also accept pre-paid orders by mail using a cashier's check or money order. Orders will be processed immediately upon receipt. All orders are subject to acceptance.

PRICES ARE SUBJECT TO CHANGE WITHOUT NOTICE!

RETURNS: All claims for return must be made within three (3) days from receipt of order. We will accept only AUTHORIZED returns 30 days from date of invoice. Special orders or customized items are NON-CANCELABLE and NON-RETURNABLE. NO EXCEPTIONS, unless defective. IN STORE CREDIT will be issued only for items returned in resaleable condition. A restocking fee may be charged on all returns, unless return is due to a manufacturer's defect or OUR mistake. Restocking fee is generally 20% but may vary depending on the order.

SHIPPING ADDRESS CORRECTION FEE: Orders that are shipped to the address customer provides and require address correction by carrier will be charged a "Correction Fee" of $10.00.

NON-RETURN OF ITEMS: The customer authorized EmergencyLights4Less.com and it's agents to charge their credit card for charges of merchandise that is not returned in a timely manner.

SHIPPING AND HANDLING CHARGES will be added to all orders unless we specifically offer a delivered price. We generally ship UPS Ground service. Other modes may be requested on a best-efforts-to-comply basis.

DAMAGED, LOST, OR SHORT SHIPMENTS must be reported IMMEDIATELY. Keep damaged goods and containers for inspection until you are advised to dispose of them. For UPS shipments, notify your local UPS office immediately. If you accept a damaged or short shipment from the delivering carrier's agent without proper notation, you do so at your own risk.

LIMITED WARRANTY: EmergencyLights4Less.com warrants its products to be free from defects in materials and manufacturing workmanship for a period of 30 days from the date of your invoice, assuming normal use. Dimensions and specifications may be changed at the discretion of EmergencyLights4Less.com, or the manufacturer. No oral or written information or advice given by EmergencyLights4Less.com, or its authorized representatives, agents, or employees, will create any warranty of any kind. In the case of items manufactured by others, all technical specifications and information are supplied for your information and convenience only and do not create any warranty of any kind. EmergencyLights4Less.com does not warrant or represent that any merchandise complies with the provisions of any state or federal law or regulation. If any product is defective, the entire liability of EmergencyLights4Less.com, and your exclusive remedy, shall be limited to either replacement of the defective product or return of the purchase price, at the sole discretion of EmergencyLights4Less.com. If the failure of the product has resulted from normal wear and tear, abuse, misuse, neglect, accident, or lack of reasonable and proper care and maintenance, EmergencyLights4Less.com, shall have no obligation to replace the defective product or refund the purchase price. Any implied warranties regarding the product, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to 30 days from the date of your invoice. PLEASE NOTE that each individual manufacturer holds all product warranties. Defective items, under the manufacturer's warranty, must be returned directly to the manufacturer.

STROBE TUBE CLAIMS: Strobe tubes carry a 1 year manufacturer's warranty, and must be returned to the manufacturer! Improper installation resulting in breakage of the tube is NOT covered under the manufacturer's warranty. All strobe tubes are inspected before leaving the factory for breakage. All claims for strobe tubes damaged during shipment must be made with the shipping carrier.

ALL INSTALLATIONS ARE THE SOLE RESPONSIBILITY OF THE PURCHASER. WITH ALL MAGNETICALLY MOUNTED WARNING DEVICES, USE ON THE EXTERIOR OF MOVING VEHICLES IS AT THE SOLE DISCRETION OFF THE USER. ALTERATIONS TO THE MAGNET SURFACE WILL VOID THE WARRANTY.

RETURN AND/OR EXCHANGE: We will gladly take back any item you are not 100% satisfied with. Returns must be made within 30 days of the date of sale.

SHIPPING CHARGES ARE NON-REFUNDABLE. All returned items for exchange must be new, unused, not installed and in their original packaging including all original hardware and instructions. PLEASE NOTE! Any items showing wear, damage, modification, or installation ( which includes scratches, dents, and cut or stripped wires ) will not receive a refund. Any item not in original packing or missing instructions WILL be subject to a 25% restocking/repacking fee. Any items that have been installed and don't work must be returned to the manufacturer. IF YOU ARE MISTAKENLY SENT THE WRONG ITEM, we will be happy to send the correct item ONLY after we receive the wrong item back.

ALL RETURNS MUST HAVE PRIOR APPROVAL!

LIMITATION OF LIABILITY: Under no circumstances shall EmergencyLights4Less.com, its owners, agents or employees, be liable for direct, indirect, special, incidental, or consequential damages, including but not limited to damages for loss of business profits, costs of labor, loss of time, cost of obtaining substitute products, inconvenience, and any other damage costs, arising out of the purchase of any product, even if EmergencyLights4Less.com, its owners, agents, or employees, have been advised of the possibly or occurance of such damages. The warranties and remedies above regarding defective merchandise are exclusive and in lieu of all others, oral or written, expressed or implied. In the event any other disclaimer of warranty or limitation or liability in this AGREEMENT is determined to be unenforceable or is otherwise ineffective in whole or in part, any liability of EmergencyLights4Less.com, its owners, agents, or employees, to you for any and all damages, losses, and causes of action, shall be limited to the amount of purchase price paid to EmergencyLights4Less.com, for the product purchased. This warranty gives you specific legal rights. Consumers may have other rights which vary from state to state.

ENTIRE AGREEMENT: This AGREEMENT constitutes the entire agreement between you and EmergencyLights4Less.com, with respect to the product, and supersedes any and all prior or contemporaneous agreements or understandings, whether oral or written. No amendment to or modification of this AGREEMENT will have any binding legal effect unless it is made in writing, is signed by a duly authorized representative of EmergencyLights4Less.com, and specifically states that it supersedes, modifies, or amends terms or provisions of this AGREEMENT.

SEVERABILITY: This AGREEMENT shall be construed to make each provision enforceable to the maximum extent possible under governing law. If any provision of this AGREEMENT is determined by a court of competent jurisdiction to be contrary to law, that provision will be enforced to the maximum extent permissable so as to effect the intent of the parties, and the remaining provisions of this AGREEMENT shall remain in full force and effect.

NO WAIVER OF RIGHTS: Failure or delay of EmergencyLights4Less.com, in enforcing any right or provision of this AGREEMENT shall not be deemed a waiver of such provision or right with respect to any subsequent breach or a continuance of any existing breach, whether or not demand for strict performance has been made.

CHOICE OF LAW AND VENUE: This AGREEMENT shall be governed and interpreted in accordance with the laws of the State of Pennsylvania. Any trial level proceedings relating to this AGREEMENT shall be maintained in the state or federal courts located in Northumberland County, Pennsylvania, and any appellate proceedings shall be maintained in the courts having appellate jurisdiction over proceedings originating in the state of federal courts located in Northumberland County, Pennsylvania. These courts shall have exclusive jurisdiction over all such proceedings, and by accepting the terms of this AGREEMENT, you consent to the personal jurisdiction of these courts.
